These Terms of Service ("Terms") govern your access to and use of the OWA website, mobile applications, member portal, wellness facilities, events, and related services ("Services").

By creating an account, booking a reservation, purchasing a membership, or otherwise using our Services, you agree to be legally bound by these Terms.

If you do not agree with these Terms, please do not use our Services.

2. Eligibility

To use OWA you must:

  • Be at least 18 years old, or
  • Use the Services under the supervision of a legal guardian where applicable.

You represent that all information provided during registration is accurate and up to date.

3. Your OWA Account

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity occurring under your account.
  • Updating your personal information when necessary.

OWA reserves the right to suspend or terminate accounts that violate these Terms.

4. Reservations

Reservations may include:

  • Wellness experiences
  • Sauna sessions
  • Contrast therapy
  • Recovery treatments
  • Private cabins
  • Social areas
  • Rooftop access
  • Events
  • Hotel accommodations

Availability is subject to change until a reservation is confirmed.

OWA reserves the right to cancel or modify reservations due to operational or safety reasons.

5. Payments

All payments are processed securely through authorized payment providers.

By completing a purchase, you authorize OWA to charge the selected payment method for all applicable fees.

Prices may change without prior notice.

Taxes will be displayed when applicable.

6. Cancellation Policy

Cancellation policies vary depending on the reservation type.

Applicable cancellation rules will be displayed during checkout.

Failure to attend a reservation without cancellation ("No Show") may result in forfeiture of the reservation fee.

7. Memberships

Memberships are governed by additional Membership Terms and Conditions.

Membership benefits are personal and non-transferable unless expressly stated otherwise.

OWA reserves the right to modify membership benefits with reasonable notice.

8. Guest Invitations

Members may invite guests when permitted by their membership.

Guests must accept OWA's Guest Liability Waiver before participating in any experience.

OWA reserves the right to deny admission to guests who fail to complete required documentation.

9. Health & Wellness Disclaimer

OWA provides wellness experiences and recovery services.

Our Services:

  • are not medical treatments,
  • do not replace professional medical advice,
  • are not intended to diagnose, treat, cure, or prevent disease.

You are solely responsible for determining whether participation is appropriate for your health condition.

If you have any medical concerns, consult your physician before participating.

10. Assumption of Risk

Participation in activities including, but not limited to:

  • Finnish sauna
  • Infrared sauna
  • Cold plunge
  • Breathwork
  • Stretching
  • Fitness activities

involves inherent risks.

By participating, you voluntarily assume all associated risks.

11. Personal Property

OWA is not responsible for:

  • lost items
  • stolen property
  • damaged belongings

Guests are encouraged to secure their valuables at all times.

12. Facility Rules

Visitors agree to:

  • Respect staff and other guests.
  • Follow all posted safety instructions.
  • Use equipment responsibly.
  • Maintain appropriate conduct.
  • Refrain from disruptive behavior.

OWA reserves the right to remove any individual whose conduct jeopardizes the safety or enjoyment of others.

13. Prohibited Conduct

Users may not:

  • misuse the Services,
  • attempt unauthorized access,
  • interfere with platform security,
  • upload malicious software,
  • impersonate another individual,
  • violate applicable laws.

14. Intellectual Property

All content including:

  • logos
  • branding
  • software
  • photographs
  • videos
  • graphics
  • written materials

remain the exclusive property of OWA unless otherwise indicated.

No content may be copied or reproduced without written permission.

15. Privacy

Your use of OWA is also governed by our Privacy Policy.

16. Limitation of Liability

To the maximum extent permitted by law, OWA shall not be liable for:

  • indirect damages,
  • incidental damages,
  • loss of profits,
  • business interruption,
  • personal decisions made based on wellness information provided by OWA.

Our total liability shall never exceed the amount paid for the specific reservation or service giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless OWA, its owners, employees, contractors, affiliates, and partners from claims arising from:

  • your misuse of the Services,
  • violation of these Terms,
  • negligent or unlawful conduct.

18. Force Majeure

OWA shall not be liable for delays or inability to perform due to events beyond its reasonable control, including:

  • natural disasters
  • pandemics
  • governmental actions
  • utility failures
  • labor disputes
  • acts of God

19. Governing Law

These Terms shall be governed by the laws of the United Mexican States.

Any disputes shall be submitted to the competent courts of Mexico City unless otherwise required by applicable consumer protection laws.

20. Changes to These Terms

OWA may update these Terms periodically.

Continued use of the Services after modifications constitutes acceptance of the revised Terms.
